Educational Music Guidelines

The music guidelines govern both printed music and sound recordings (audio disk, cassette or tape recordings). Multiple copying of printed music for classroom situations is permitted as long as it does not exceed the limitations in Permissible Uses item (2).

NOTE: No educational permission is granted for recordings which may be governed by both music and sound recording copyrights.

Permissible Uses

  1. Emergency copying to replace purchased copies that are not available for an imminent performance provided the photocopies are later replaced with purchased copies.
  2. For academic purposes (other than performance) single or multiple copies of excerpts of works may be made, provided that the excerpts do not comprise a part of the whole which would constitute a performable unit. In no case should the excerpt exceed 10% of the whole work. Performable units include a selection, movement, or aria. The number of copies shall not exceed one copy per student.
  3. Purchased printed copies may be edited or simplified provided that the fundamental character of the work is not distorted. When lyrics are part of the music, they may not be altered. Lyrics may not be added if none previously existed.
  4. A single copy of recordings of student performances may be made for evaluation or rehearsal purposes and may be retained by the College or individual instructor.
  5.  A single copy of a copyrighted music recording (such as a tape, disc, or cassette) may be made from music recordings owned by the College or an individual instructor for the purpose of constructing aural exercises or examinations and may be retained by the College or individual instructor. (This pertains to the copyright of the music and not to any copyright which may exist in the sound recording.)

Prohibitions

  1. Copying to create, replace, or substitute for anthologies, compilations, or collective works.
  2. Copying of or from "consumable" works in the course of study or of teaching. Consumables include workbooks, exercises, standardized tests and answer sheets, and like material.
  3. Copying for the purpose of performance, except in Permissible Uses 
  4. Copying for the purpose of substituting for the purchase of music, except as in Permissible Uses (1) and (2).
  5. Copying without including the copyright notice that appears on the printed copy
