Medium You May Fine Print
Digital Transmissions Engage in mediated instructional activities that use qualified works. Qualified works must be an integral part of the class experience.
  Use non-dramatic literary and musical works. Plays, movies, concert productions have different rules.
  Use reasonable and limited portions of dramatic works -- audiovisual works and dramatic, musical works. Think "snips and clips".
  Use materials that the performance of display is directly related and of material assistance to the teaching content of the transmission. If using an instructional video produced by a company, seek permission either at purchase point or before showing.
  Use thumbnail images. 200 x 200 or smaller with a file size less than 3 - 10 k.
  Perform or display materials made by, at the direction of, or under the supervision of an instructor.  
  Perform or display reasonable and limited portions of any work not addressed above.  
  Display a work in an amount comparable to that which is typically displayed in the course of a live classroom session. Within limits identified.
  Perform or display materials that are directly related and of material assistance to the teaching content of the transmission session. Within limits identified.
  Perform or display materials that are offered as a regular part of the systematic, mediated, instructional activities.  
  Provide transmissions when their reception is, to the extent technologically feasible, limited to students officially enrolled in the course for which the transmission is made. Easier to use copyrighted materials in Desire2Learn.  Avoid using copyrighted materials in open television broadcasts unless permission is obtained.
  Avoid  
  Using textbooks, course packs, workbooks and materials specifically developed and marketed for distance learning. Textbooks, course packs, and workbooks are not to be copied into the online class in order to supplant purchase by students.  Faculty may use publisher provided faculty resources designed for online delivery that accompany student textbooks, course packs, and workbooks. 
  Using PBS videos or other commercially produced products. Purchase a license to use these materials.
  Taking items from an illegal site and using them in your distance education course. Napster and many private web pages fall in this category.
  Transmitting a copy or recording that was not lawfully made. Do not use a copy of a broadcast after the time limit has expired.
  Transmitting a performance as a reward.  
Transmitting material over an open broadcast channel. Obtain a license to use this material in this manner.
  The College Will  
  Apply technology measures that reasonably prevent retention of the work in accessible form by recipients of the transmission for longer than the class session.  
  Apply technological measures that reasonably prevent unauthorized further dissemination of the work in accessible form by recipients to others.  
  Not engage in conduct that could reasonably be expected to interfere with technological measures used by copyright owners to prevent retention or unauthorized further dissemination.  
Definitions

A performance is defined as reading a literary work aloud, signing or playing music, acting out a dramatic work or pantomime, using a transmitting apparatus, or using an electronic retrieval system.  Showing portions of a motion picture, filmstrip, or slide set sequentially constitutes a performance.

Display of a copyrighted work occurs when a copy of the work is shown either directly or by means of a film, slide, television image, or other device or process (as in a distance education delivery of instruction).
